Removal or Substitution of an Executor or Administrator
Section 33 of Probate Administration Ordinance states that :
The court may, if satisfied that the due and proper administration of the estate and the interests of the persons beneficially entitled thereto so require, suspend or remove an executor or administrator (other than the Official Administrator) and provide for the succession of another person in place of such executor or administrator and for the vesting in that other person of any property belonging to the estate.
In some cases, the executors or administrators, after being appointed by the court, are opposed by someone to be so appointed. The court may remove the executors or administrators and have them being replaced by other suitable persons.
In the case of SHIH CHIA CHEONG , Administrator of the Estate of SHIH CHIA YING , Deceased and LI LIU ZHU, HCMP 2054/2012, the Plaintiff and Defendant were co-administrators. The Plaintiff applied to have them being replaced by two independent professionals. The application was granted by the court.
